I was just informed by a good friend and outfitter that the house passed a bill that will put more regulations on outfitters, and although I am not against regulations this bill will basically ruin the small guide or outfitter. The bill was snuck through the channels and hardly anyone knows about it. (this was done on purpose)
If you want to support your guide/outfitter friends please have them go to this website and read about this bill. The bill is HB 0173. To read more about this go to www.utah.gov then to the senate link. I won't post the name of the ONE outfitter in Utah that wants this passed, but this is strictly a bill to eliminate competition in the future. I firmly believe that we need the small time guides/outfitters....not everyone can afford the elite. Hope you will take the time to read more about this and take action within the next couple of days as it has already passed the House. Here are a list of your State representatives that you can e-mail to vioce your opinion on this. I just learned about this tonite so please bear with me.

My source is VERY reliable :) I just hope for all smaller Outfitters/Guides sake it does not pass. Competition is good, and not everyone can afford to pay what some charge. I agree on all legality, but I'm always for the little guy just trying to make an honest way through life without a bunch of Political B.S. :)

Looks like the bill will introduce guide licensing to the state of Utah.

It appears that everyone acting in the capacity of a guide will have to be licensed by the DWR and pay a fee and pass certain requirements to be able to become licensed and stay licensed.

That means all guides will have to be atleast certified in CPR, and will have to leave all helicopters and ultralights at home.

Operating in other regulated states has shown me what a giant waste of time and money it takes to regulate, and that $$$ could & should be used elsewhere. The regulated system is easily used to keep the small guys, or guys that would like to get into the business at bay.

This is just a way for the Gov. to get bigger and make more money. Looks like Nevada all over again. Not a big deal just a pain in the butt. It will cost the outfitter which will cost the customer.

Line 69-70 reads "Wildlife related activity" means to hunt, pursue, catch, capture, trap, kill, LOCATE or collect protected wildlife or its PARTS.

I think that pretty much covers everything from scouting to picking up sheds. Sounds like a full time police job too. Should be a cash cow for the Gov.

I don't see how any outfitter benefits more or less from this bill.

I have to have a license, pat fees, have all kinds of insurance, take BS tests, and take 6 hours of continuing education every year (which I have to pay for) just to keep my license, so I don;t feel to bad ;-)

Well looks like outfitters are headed where they will have an area in the state instead of the run of the state. At least it will throttle back the out of state outfitting operations. Kinda of have to wonder how areas will be allocated. Cant say weather I like the idea or not, just have to see how it shakes out.

The girl that charges $9 for a haircut at Great Clips has to go to school and be licensed by the state. But someone guiding a person that is carrying a high powered weapon around and getting paid thousands of dollars isn't required to have a license from the state????

I know nothing about outfitting rules and regs, but isn't wyoming regulated somewhat like this? If they are it still seems to be working out fine for them

I just read the bill line for line, and it seems plenty logical to me. Is it the fee that you are worried about?

Why wouldn't any guide worth his salt, want to be registered, given the pretty lax rules for being registered. If you are really a "guide" wouldn't you want the guys that are out there screwing folks, giving you all a bad name, to drop out? If you charge someone money to guide them, why can't you then be licensed? We require doctors to be licensed, nurses, lawyers, bus drivers, etc., why not guides?

God, all a lot of you do is beotch. Piss on it if it harms me and my way.

Someone tell me, where is the problem? I'm guessing its the fee. What if the fee is only $50? Any problem then? Lets find out who is really worth their salt?

(1) (a) The executive director shall appoint the members of the boards established under this title. In appointing these members the executive director shall give consideration to recommendations by members of the respective occupations and professions and by their organizations.

well, I hate to sound like a prick but I think that's bull$hit. I'm not a fan of any of the guide drama that goes on but shouldn't it be regulated in some way so the customer has a reasonable expectation of being taken care of and a legal recourse if he's not? Do they even have to have a business license? Insurance? Permits? Anything?

As far as what the DWR wants for an outfitter. You need need to have a business lic. and carry insurance. Then on top of that the forest service requires insurance, fees, and training.

Since the state controls the business lic. If an outfitter is doing illegal things, or acting unsafe, or not providing a quality service. Then the state can revoke the business lic. And the forest service and BLM can revoke the special use permit.

Nowhere in this bill is there a provision for allocating areas to a limited number of outfitters.

It appears to be modeled after NM's guide and outfitter laws, making it easier for the DWR to enforce themselves rather than have to go thru the FS or BLM.

When I was guiding in colorado they made pass a cpr class which I thought was good thing

All guides are required to be first-aid/CPR certified. All outfitters are required to have a LLC, be insured/bonded, have special use permits for EVERY US forest service/BLM parcel in order to legally outfit/guide in Utah. Those saying "anyone with a 4X4 can guide" is mistaken.

Not trying to argue Pro but who enforces all that?
What agency requires the LLC?
The bonding?
You need to call the BLM and FS to check for permits?

If I have a problem with an outfitter I need to have one number to call, one agency that handles all of it.

if the guide and outfitters are running a business then they should have a business license and carry insurance.

It will be good to get rid of some of the small town guides running around.

I tried to start a outfitters buisness in 03 There was alot of red tape the insurance policy had to be worth 1 millon dollars the FS permits were a joke you had to be a lawyer to figure out what they wanted in the letter for the permits telling them how you would be staying in tents campers,riding in on horseback I knew sooner or later that the dwr would become more involved in this and as far as the cpr back in 03 was not required in the state of utah cause threr was no one over to check to see if anybody was current on the cpr .outfitters in utah they must have changed that.
