But you don't actually have to be convicted of illegally taking the animal and you don't have to be part of the hunt at all. You can literally be handed a skin that you have no knowledge whatsoever of any law broken to kill or transport the entire animal or parts and you can still be prosecuted by the feds.I am not posting this for the lap dog, but if anyone is actually interested in what the Lacey Act says, the animal or plant in question must be ILLEGALLY taken, possessed, transported, or sold in violation of any law, treaty, or regulation of the U.S., a state, or any foreign law. So yes, violations of STATE law (or even foreign laws) implicate the Lacey Act.
If the animal is lawfully taken, possessed, transported, or sold—then no Lacey Act violation. People can Tri and distract, but if no poaching happened, the feds wouldn’t have put Wade Lemon in federal prison. Period. End of story.
