I'm confused??

A friend of a friend of a friend tells me that he got his bull last week on a unit that as far as I can tell you cannot hunt without drawing an LE tag. I've read the proc a couple times, so tell me if I'm wrong. There are any bull units and spike bull units, some of which are also LE units with no archery season. But it also appears there are numerous LE ONLY units with archery seasons, but you could only hunt those if you drew a LE tag, right??

For example, I could archery hunt spikes on the Wasatch, but not hunt some of the southern units without drawing the tag.

Am I right or wrong or just plain confused? Cuz the proc is bit vague.

Everything you just mentioned sounds correct pred. If this person harvested a branch antlerd bull on a spike only unit without a LE tag, call 1-800-662-DEER. If you look at the hunt maps and read the proclimation it is very clear. There are very few "any bull" units. I have seen to many cases where guys harvest large bulls cause they didnt read the proc. That or they just can't resist the temtation and play dumb. Good luck on this one.
 
Frky, it's not that he harvested a branch antlered bull on a spike unit; it's that the unit he harvested on is neither designated as a spike only or any bull.....it's a LE. The map doesn't show it as anything for a general season tag, and the rules for archery elk don't prohibit hunting LE units specifically...that's why I'm confused.

Congradulations on a free LE tag then for next year... which is the reward for turning in a poacher.

DallanC, I was just at Sportsmans looking at the Magazine "Hunting Illustrated" & I saw where you & your wife's archery bucks are in there from last year. Pretty sweet! Just thought I'd tip my cap to ya.

I killed my first archery buck last year, a 4x3 that was ok, nothing "monster" about it though. My wife shot a nice 4x4 on the rifle hunt but it wasnt a monster either. Both picts floated around on the net but I doubt they were used in any magazines.

Prolly was COLO3D's deer.

Here's the rule from the 2005 Proc.

R657-5-47:
(1) To hunt a premium limited entry or limited entry elk area, a hunter must obtain the respective premium liited entry or limit entry elk permit.
----------------------------------------------------

I think that's pretty unequivacal. If he shot any branch antlered bull on any LE unit whether spike bull unit or pure LE, he was poaching.

Turn him in and you'll get a LE permit for next year from the DWR.

If he shot a branch antlered bull anywhere but in the few areas marked "any bull" on the general hunts map and did not have a "special" tag (LE, CWMU etc.), he poached. End of story. (unless he was in one of the extended archery areas). Do you know where it was?

Pete, that's why I'm confused. Yet we can still hunt the Wasatch and other LE units for spikes. However, the map does not indicate ALL LE units are spike units. So I'm assuming that some LE units are not open for general archery at all. Like Fillmore, San Juan, Dutton, etc. See what I'm saying? The general archery rule says that you can take any elk on a general any bull unit, an antlerless or spike on a spike bull unit. It says nothing about a unit that is designated neither.

Andy, I only know what was told to me 4th hand. That's why I'm trying to get things straight before I do anything.

Thanks for your help guys, I've found that the folks that answer the poaching hot line are volunteers, and don't know the intricacies of the law. I've been put on hold so many times I could spit. Today I'm calling the warden in the area I think it was taken, if he doesnt know then I guess I give up.
 
The maps and units can definitely be confusing when it comes to Elk. Here are the limited entry elk units that allow general spike hunting:
Cache units
Wasatch Mtns.
Central Mtns, Nebo
Central Mtns, Manti
Beaver
Plateau, Fish Lake
Plateau, 1000 Lakes
Plateau, Boulder
Lasal Mtns

All other limited entry units allow elk hunting for mature bulls only with the appropriate limited entry tag. General archery hunting is not allowed at all on these other units. Turn the dude in and enjoy a free LE hunt on the division next year!!

Be carefull because the Wasatch unit is not the same as the Wasatch Front. We were in some bulls last weekend here in the Wasatch mountains in Big Cottonwood Canyon and we could have shot whatever elk we wanted since its an any bull unit.
